These terms are an agreement between Kanishu Technologies (U-001, Mantri Paradise, Arekere Gate, Bannergatta Road, Bangalore - 560076) ("we", "us") and the organisation that creates an account or buys a subscription ("you"). By creating an account or using any of our products you agree to them. If you accept them for an organisation, you confirm you are authorised to do so.
1. The service
We provide business software as an online service. What each plan includes, and its price, is published on each product's page. We may improve or change the products over time. We won't take away a feature your current plan is sold with during a period you have already paid for.
2. Your account
- Give accurate details, including your GSTIN if you want GST input credit, and keep them up to date.
- Keep sign-in details safe; we recommend multi-factor authentication for everyone. You are responsible for what happens under your organisation's accounts.
- Tell us straight away if you think an account has been misused.
3. Prices, payment and renewal
- Subscriptions are paid in advance for the billing period you choose. Prices are in Indian rupees and GST is added at the applicable rate. You receive a GST tax invoice for every payment.
- When a subscription is near its end we email a reminder. You renew it yourself from your account; nothing is charged automatically.
- If you move to a higher plan or add seats part-way through a period, you pay only the difference for the rest of that period.
- We may change prices for future periods. A change never affects a period you have already paid for, and we will tell you before it applies to your next renewal.
- If a subscription isn't renewed, access to that product stops when the paid period (and any grace period we have agreed) ends.
4. Cancellation and refunds
You can stop at any time by not renewing; you keep access until the end of the period you have paid for. Amounts already paid are not refundable, except where the law requires a refund or where we charged you in error, in which case we refund the amount charged in error to the original payment method.
5. Your data
- Everything your organisation puts into the products stays yours. We use it only to provide the service to you, as described in our Privacy policy.
- You can export your data from the products while your subscription is active, and for as long afterwards as you need to renew or export it.
- After your subscription ends you can ask us to delete your data, and we will, except for records the law requires us to keep.
- You are responsible for having the right to put any personal data into the products, and for responding to requests from the people it is about. We help you do this.
6. Acceptable use
You must not:
- break the law, or use the service to store or send unlawful, infringing or harmful material;
- try to get into accounts or data that aren't yours, test our security without our written permission, or disrupt the service;
- resell the service, or copy or reverse-engineer it, except as the law allows;
- use automated means to load the service beyond normal use, except through the API access we grant you.
We may suspend access that breaks these rules or puts the service or other customers at risk. Where we can, we will tell you first and give you a chance to fix it.
7. Availability and support
We work to keep the service available and secure and to fix problems promptly, but we can't promise it will never be interrupted — for example during maintenance or because of events outside our control. Support is available by email at [email protected].
8. Our responsibility to you
- The service is provided "as is". Apart from what these terms say, we make no other promises about it, to the extent the law allows.
- Neither of us is liable to the other for indirect or consequential loss, or for loss of profit, revenue or goodwill.
- Our total liability to you for any claims about the service is limited to the amount you paid us for it in the 12 months before the claim.
- Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud.
9. Ending the agreement
You can close your account at any time. We may end it if you seriously break these terms and don't fix the problem within 15 days of our notice, or straight away if the law requires. Sections 4, 5, 8 and 10 continue to apply after it ends.
10. Law and disputes
These terms are governed by the laws of India. Courts in Bangalore have exclusive jurisdiction over any dispute about them. Before going to court, both of us will try in good faith to settle the dispute by talking to each other.
11. Changes to these terms
If we change these terms in a significant way, we will email account holders at least 30 days before the change takes effect. If you don't agree, you can stop renewing; the terms in force when you paid continue to apply until the end of that period.
